Overview:

The HR Leave and Accommodations Advisor serves as a consultant to management on human resources related issues and acts as a champion and change agent. Assesses and anticipates HR needs, providing solutions and delivering value-added services that reflect the objectives of the organization. Is responsible for managing and supporting company-wide policies and programs related to leaves of absence, disability accommodations, and compliance with the Americans with Disabilities Act (ADA). This role partners with department leaders, employees to ensure the company’s practices align with federal, state, and local employment laws. The HR Leave and Accommodations Advisor provides expertise in managing cases related to FMLA, ADA, and any related leave programs, fostering an inclusive workplace.

Responsibilities:

Leave Management:

  • Administer and manage the full cycle of employee leaves, including FMLA, ADA, parental leave, LOA and other state and federal leave programs.
  • Ensure legal compliance in processing and tracking leaves and provide guidance to employees and managers on leave entitlements and obligations.
  • Maintain accurate records of leaves and accommodations, ensuring confidentiality and compliance with all regulations.
  • Partner with third-party vendors to facilitate leave claims, and monitor claims status to ensure timely processing.

ADA and Accommodations:

  • Serve as the subject matter expert on ADA compliance and reasonable accommodations.
  • Engage in the interactive process with employees to determine appropriate accommodations, ensuring alignment with business needs and legal obligations.
  • Collaborate with designated parties and/or department managers to ensure the implementation of reasonable accommodations in a manner that maintains operational efficiency.
  • Educate managers and staff on ADA requirements and responsible for creating training materials or sessions on the company’s policies on disabilities and accommodations.

Compliance and Legal Expertise:

  • Stay up-to-date on federal, state, and local leave and disability laws and communicate updates to management.
  • Advise managers and leadership on HR policies and procedures regarding leaves and accommodations to minimize legal risks and ensure compliance.
  • Investigate and resolve complex leave and accommodation issues, working with internal and external stakeholders.
  • Provide regular reports on leave status, accommodation trends, and compliance metrics.

Employee Relations:

  • Act as a resource to employees for questions or concerns related to leaves and accommodations.
  • Ensure a consistent, fair, and respectful process for managing all leave and accommodation cases.
  • Manage escalations and disputes related to leaves and accommodations, ensuring resolution in line with legal requirements and company policy.

Collaboration:

  • Work closely with other HR functions to ensure a holistic approach to managing leave and accommodation requests.
  • Assist with broader HR initiatives where leaves and accommodations intersect.

Learning and Development:

  • Identify Operational leadership training needs relating to Employee management and create and implement relevant programs
  • Support leadership development initiatives and create strategies for upskilling talent.
Qualifications:

Required Education and Experience

  • Bachelor’s degree in Human Resources, Business Administration, or a related field; HR certifications (PHR, SPHR, SHRM-CP) preferred.
  • 5-7+ years of experience in human resources, with a proven success in managing leaves of absence, ADA compliance, and accommodations.

Preferred Education and Experience

  • Experience working in a healthcare environment is a plus.
  • Familiarity with other employment laws and regulations, such as the Fair Labor Standards Act (FLSA) and Equal Employment Opportunity (EEO) laws.
  • Ability to conduct training and develop educational materials for managers and employees on leave and accommodation policies.
